Client & Carer Contract.

This document is the standard template for the legal agreement between you (the “Client”) and the self-employed Carer (the “Carer”) introduced by MG Live-In Care Services. It outlines the terms of the care service to be provided.

1. Parties to This Agreement

1.1. This Care Contract (the “Agreement”) is made between:

  • (1) The “Client” (the person receiving or arranging the care, referred to as “you”, “your”); and
  • (2) The “Carer” (the self-employed care professional introduced by MG Live-In Care Services, referred to as “they”, “their”).

1.2. Important Note on Our Role: MG Live-In Care Services LTD (“the Agency”) is not a party to this Agreement. The Agency acts solely as an introductory service to connect the Client and the Carer. This Agreement governs the direct relationship between the Client and the Carer for the provision of care services.

2. The Carer’s Services and Obligations

2.1. The Carer agrees to provide the care services as detailed in the mutually agreed-upon Care Plan. The Care Plan will be developed by the Client and the Carer and will outline the specific tasks, routines, and preferences for the care to be provided.

2.2. The Carer will perform all services with reasonable skill, care, and diligence, and will treat the Client with dignity and respect at all times.

2.3. Carer’s Status: The Carer performs their services as a self-employed professional. The Carer is responsible for their own tax, National Insurance contributions, and for maintaining their own public liability insurance. The Carer is not an employee of the Client or the Agency.

3. The Client’s Obligations

3.1. You agree to provide the Carer with a safe, clean, and appropriate working environment at all times.

3.2. Accommodation for Live-in Carers: You will provide the Carer with a private, furnished room with a comfortable bed, adequate heating, and access to bathroom and kitchen facilities. You will also provide reasonable access to Wi-Fi.

3.3. Meals: You will provide the Carer with reasonable food and drink for three meals per day, or a reasonable allowance for the Carer to purchase their own food, as agreed in advance.

3.4. Respect: You agree to treat the Carer with courtesy, respect, and professionalism at all times.

4. Fees and Payment

4.1. You agree to pay the fees for the Carer’s services as set out in the Fee Proposal provided by the Agency. The fee is inclusive of the Carer’s rate and the Agency’s commission.

4.2. Invoicing: The Agency will issue invoices on behalf of the Carer. You agree to pay all invoices in full and without deduction or set-off within 7 days of the invoice date.

4.3. Late Payment: If you fail to make any payment by the due date, we reserve the right to charge interest on the overdue amount at a rate of 4% per annum above the Bank of England’s base rate from time to time.

5. Cancellations and Termination

5.1. Cancellation Before Commencement: If you wish to cancel an assignment before it begins, you must provide at least 1 day (24 hours) written notice. If less than 24 hours’ notice is given, a cancellation fee may be payable.

5.2. Termination During an Assignment: Either the Client or the Carer may terminate this Agreement by providing written notice explaining the reason for termination, which shall be reviewed and approved within 1 day (24 hours) by the other party and the Agency. This termination is not limited to a breach of contract but may also apply to ordinary or reasonable circumstances that justify ending the assignment.

5.3. Immediate Termination: Either party may terminate this Agreement with immediate effect by giving written notice if the other party is in serious breach of their obligations (including, but not limited to, any form of abuse, harassment, or illegal activity). If the affected party is unable to provide written notice immediately, they may notify the other party and the Agency by phone, followed by a written notice as soon as reasonably possible.

6. Liability

6.1. As a self-employed professional, the Carer is liable for their own acts and omissions. The Carer is required to hold adequate public liability insurance to cover their work.

6.2. The Agency’s liability is strictly limited to its role as an introductory service. The Agency is not liable for the acts, omissions, or negligence of the Carer. Our liability is detailed in the separate Introducer Agreement between you and the Agency.

7. Confidentiality and Data Protection

7.1. The Carer agrees to keep all of your personal and medical information strictly confidential and will not disclose it to any third party without your consent, except as required by law.

8. Dispute Resolution

8.1. In the event of a dispute between the Client and the Carer, both parties agree to first attempt to resolve the matter amicably between themselves.

8.2. If the dispute cannot be resolved directly, either party may contact the Agency, which will, in its capacity as a neutral intermediary, attempt to facilitate a resolution.

9. General

9.1. Entire Agreement: This Agreement, along with the Care Plan and the Fee Proposal, constitutes the entire agreement between the Client and the Carer.

9.2. Governing Law: This Agreement and any dispute or claim arising out of it shall be governed by and construed in accordance with the law of England and Wales.

9.3. Jurisdiction: Both parties agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim.
